KENDALL COUNTY, TEXAS — San Antonio attorney Karen Kay Hogan was sentenced to 20 years in prison on June 1 for misapplying over $541,000 from the estates of a murdered Boerne couple. Kendall County District Judge Kirsten Cohoon ordered Hogan to pay $189,678.50 in restitution and a $5,000 fine.

Hogan pleaded guilty on March 20 to misapplication by a fiduciary and exploitation of a disabled individual. Deputies found Jason Marcus Evans and Emily Elizabeth Fulton Evans dead from gunshot wounds at their Boerne residence on December 31, 2021. Investigators determined Jason Evans was the shooter. The couple's six children, aged 4 to 15, were inside during the shooting.

A judge appointed Hogan as temporary administrator for the estates on November 15, 2022. Accounts opened in 2023 listed Hogan as a joint owner. Between August 2023 and February 2024, Hogan transferred funds to her business account and wired money to unknown accounts without court authorization. By March 2024, the estate balances were depleted. Hogan told investigators she transferred funds to an online romantic relationship recipient whom sheriffs could not locate.

Prosecutor Nicole Bishop addressed the court. "If she really cared about those kids, she would have paid the restitution immediately, and she did not." Bishop said she would not have offered the initial plea deal with knowledge presented at sentencing. Judge Cohoon noted the breach of trust. "This is the hardest case I've presided over because I can't understand such a break of trust to your clients and to the whole system we work for." Cohoon said.
